These Terms and Conditions (“Terms”) govern the use of the website operated by Douglas Creative Limited, trading as Ember Drift (“Ember Drift”, “we”, “us”, or “our”), and the purchase of products through our website.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use our website or purchase our products.

3. Products

All products sold by Ember Drift are produced on a made-to-order basis.

Due to the handcrafted, artistic, printed, or custom-produced nature of our products:

·      Each item may vary slightly from the images displayed on our website.

·      Colours may appear differently depending on individual screen and device settings.

·      Minor variations in colour, texture, finish, dimensions, framing, placement, and appearance are normal characteristics of handmade and printed artwork.

Such variations do not constitute defects.

We reserve the right to modify, discontinue, or update products at any time without notice.


4. Orders

By placing an order you confirm that:

·      You are at least 18 years of age or otherwise legally capable of entering into a binding contract.

·      All information supplied is accurate and complete.

·      You are authorised to use the payment method provided.

We reserve the right to refuse, cancel or limit any order at our discretion.

An order is accepted only when payment has been successfully received and production has commenced.


5. Pricing and Payment

All prices displayed on our website are shown in the applicable currency and may be amended without notice.

Payment must be made in full before production begins.

Prices exclude any customs duties, import taxes, local taxes, or fees imposed by authorities outside the United Kingdom. Such charges remain the responsibility of the customer.


6. Production Times

All products are produced specifically to order.

Production times shown on our website are estimates only and are not guaranteed.

Production and dispatch times may vary due to:

·      Order volume;

·      Material availability;

·      Supplier delays;

·      Technical issues;

·      Public holidays; or

·      Circumstances beyond our reasonable control.


7. Delivery

We will arrange delivery using third-party carriers.

Delivery estimates are provided for guidance only and are not guaranteed.

We are not liable for delays caused by:

·      Postal or courier services;

·      Customs clearance;

·      Weather conditions;

·      Industrial action;

·      Supply chain disruption; or

·      Circumstances beyond our reasonable control.

Customers are responsible for ensuring that all delivery details are accurate at the time of ordering.


8. Lost Parcels

If you believe a parcel has been lost in transit, you must notify us within fourteen (14) days of the expected delivery date.

We will investigate the matter with the carrier and determine an appropriate resolution where applicable.

Where tracking confirms successful delivery to the address supplied by the customer, we shall not be responsible for loss occurring after delivery.


9. Returns, Refunds and Cancellations

Made-to-Order Products

All products sold by Ember Drift are made to order and produced specifically for individual customers.

Under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, goods made to a customer’s specifications or clearly personalised are exempt from the standard 14-day cancellation period.

Accordingly:

·      Orders cannot be cancelled once production has commenced.

·      We do not accept returns for change of mind.

·      We do not offer exchanges for change of mind.

·      We do not offer refunds for change of mind.

Customers are responsible for reviewing all order details carefully before completing their purchase.


10. Faulty, Damaged or Incorrect Goods

Nothing within these Terms excludes or limits your statutory rights under the Consumer Rights Act 2015.

If a product:

·      Arrives damaged;

·      Is faulty;

·      Is not as described; or

·      Is not of satisfactory quality,

you may be entitled to a repair, replacement, refund or other remedy available under UK law.

Customers must contact us within 72 hours of delivery and provide:

·      Order number;

·      Description of the issue; and

·      Clear photographs of the product and packaging.

We reserve the right to inspect the item before determining the appropriate remedy.


11. Product Images, Colours and Variations

We make every effort to display products accurately.

However:

·      Screen displays vary between devices;

·      Printed products may differ slightly from digital previews;

·      Handmade and artistic products naturally vary.

Images are provided for illustrative purposes only.

Minor differences between product photographs and delivered items do not constitute defects.


12. Customer Responsibilities

Customers are responsible for:

·      Providing accurate personal and delivery information;

·      Reviewing all order specifications before purchase;

·      Ensuring any supplied customisation information is correct.

We shall not be liable for losses, delays, or costs resulting from inaccurate information supplied by the customer.


13. Intellectual Property

All artwork, illustrations, designs, graphics, photographs, text, branding, logos, website content and product designs remain the intellectual property of Douglas Creative Limited trading as Ember Drift unless expressly stated otherwise.

The purchase of artwork does not transfer any copyright or intellectual property rights.

Customers may not:

·      Reproduce artwork;

·      Copy artwork;

·      Distribute artwork;

·      Create derivative works;

·      Use artwork commercially;

·      Remove copyright notices.

Any unauthorised use may result in legal action.


14. Privacy and Data Protection

We are committed to protecting your privacy and processing personal data lawfully.

We process personal information in accordance with:

·      UK General Data Protection Regulation (UK GDPR);

·      Data Protection Act 2018; and

·      Applicable UK privacy legislation.

Personal data may be collected for:

·      Order fulfilment;

·      Customer service;

·      Payment processing;

We do not sell customer personal information.

15. Limitation of Liability

To the fullest extent permitted by law, our total liability arising from any order shall not exceed the amount paid by the customer for the relevant product.

If you are a consumer residing in Scotland or Northern Ireland, you may also have rights to bring proceedings within your local jurisdiction where required by law.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced on our website, constitute the entire agreement between the customer and Douglas Creative Limited trading as Ember Drift.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by us to enforce any right or provision shall not constitute a waiver of that right or provision.
